EIS PROCESS

What is an EIS?

An Environmental Impact Statement (EIS) is a detailed document required under the National Environmental Policy Act (NEPA) for federal actions that may significantly affect the quality of the human environment. It outlines the potential environmental impacts, both positive and negative, of a proposed project and evaluates alternative actions.

What is NEPA and why is an EIS required?

NEPA is a federal law that ensures environmental factors are considered in decision-making by federal agencies. An EIS is required when a proposed action may result in significant environmental impacts. The EIS process promotes transparency, informed decision-making, and public involvement.

Steps in the EIS Process

  • Draft EIS (DEIS) – Describes the impacts of the proposed action and alternatives, opportunity for public review and comment.
  • Final EIS (FEIS) – Incorporates public comments and is published for review.
  • Record of Decision (ROD) – A formal public document issued by a federal agency at the conclusion of the EIS process. The ROD:
    • Summarizes the agency’s final decision regarding a proposed action that was evaluated in the EIS.
    • Identifies the alternatives considered, including the environmentally preferred alternative.
    • Explains the rationale for the chosen alternative.
    • Describes mitigation measures that will be implemented to reduce environmental impacts.
    • Demonstrates compliance with applicable environmental laws and regulations.

Roles of USACE, CPAI, and Cooperating Agencies

  • U.S. Army Corps of Engineers (USACE): Lead federal agency responsible for preparing the EIS and issuing a permit decision
  • ConocoPhillips Alaska, Inc. (CPAI): Project applicant proposing the CD8 Project
  • Cooperating Agencies: Federal, state, or tribal entities with special expertise that review and contribute to the EIS
